El presente aviso tiene como finalidad informar a los Usuarios y demás visitantes de este sitio web, en delante, los “Titulares de los Datos Personales”, sobre el tratamiento que se da a los Datos Personales por parte de la FUNDACIÓN PEDRO Y ANGÉLICA DE OSMA GILDEMEISTER, identificada con RUC N° 20106730467 y domicilio en Jr. Montero Rosas 119, Barranco, Lima, en adelante “LA FUNDACIÓN”, y el cumplimiento de las disposiciones que establece la Ley de Protección de Datos Personales – Ley N° 29733, su Reglamento y normativas complementarias, en adelante “la Ley”.
FINALIDAD PARA LA QUE SE REQUIEREN LOS DATOS PERSONALES
LA FUNDACIÓN podrá requerir a los Titulares de los Datos Personales la información pertinente a sus Datos Personales con los siguientes propósitos:
Para promocionar los servicios y productos que ofrece.
Para coordinar la venta, entrega y gestión de los productos que ofrece.
Verificar y consultar información de clientes, proveedores, trabajadores y el Libro de Reclamaciones, con fines correspondientes a la relación que busca establecer o tiene establecida.
Por motivos de seguridad y videovigilancia.
Para compartir información con contratistas o proveedores, cuando sea estrictamente necesario para la correcta prestación de los servicios acordados.
Para obtener los datos de contacto esenciales para las relaciones comerciales, contractuales y laborales.
Para atender consultas, reclamos y dar seguimiento de las operaciones que correspondan a cada tipo.
Queda expresamente establecido que LA FUNDACIÓN reconoce el derecho de los Titulares de los Datos Personales a oponerse al uso y tratamiento de sus Datos Personales, cuando consideren que la información proporcionada no se ajusta a ninguna de las finalidades mencionadas anteriormente, o si los datos ofrecidos no son indispensables para establecer una relación contractual.
Los Datos Personales que maneja LA FUNDACIÓN serán accesibles y gestionados por los colaboradores de LA FUNDACIÓN que necesiten esta información para llevar a cabo las operaciones necesarias y atender las solicitudes de los Titulares de los Datos Personales. Dichos datos serán tratados de manera leal y lícita, y no serán empleados para fines incompatibles con los aquí descritos. LA FUNDACIÓN se compromete a resguardar la información proporcionada por el Titular de los Datos Personales con confidencialidad, adoptando medidas de control y seguridad pertinentes para prevenir la alteración, uso indebido, tratamiento no autorizado, pérdida y/o acceso por parte de terceros no autorizados.
El Titular de los Datos Personales declara expresamente que toda la información que proporciona a LA FUNDACIÓN es exacta, veraz y entregada de buena fe, liberando a LA FUNDACIÓN de cualquier responsabilidad relacionada con la veracidad de dicha información, la cual incluye, pero no se limita a, Datos Personales, laborales, patrimoniales y referencias personales que el Titular de los Datos Personales haya facilitado a LA FUNDACIÓN.
OBTENCIÓN Y TRATAMIENTO DE LOS DATOS PERSONALES
LA FUNDACIÓN podrá obtener información sobre el Titular de los Datos Personales por cualquier medio permitido por la Ley, incluyendo, pero sin limitarse a, la obtención de datos de manera presencial o a través de plataformas electrónicas y/o sitios web. Al ingresar sus datos en el sitio web o al proporcionarlos en persona, el Titular de los Datos Personales otorga su consentimiento explícito a LA FUNDACIÓN y/o a su personal administrativo autorizado para que trate la información suministrada de acuerdo con lo estipulado en la Ley.
LA FUNDACIÓN se compromete a procesar y resguardar los datos del Titular de los Datos Personales utilizando medios digitales, técnicos y/o administrativos para asegurar un nivel óptimo de seguridad.
BASES DE DATOS
El Titular de los Datos Personales es responsable de la exactitud y veracidad de la información que proporcione. En este sentido, los Datos Personales que recoja LA FUNDACIÓN se almacenarán, incorporarán o reorganizarán diligentemente de acuerdo con las finalidades correspondientes en las bases de datos de titularidad de la Fundación Pedro y Angélica de Osma Gildemeister, que se denominan “clientes”, “trabajadores” y “proveedores”. Estos bancos de datos están en proceso de registro ante el Registro Nacional de Datos Personales del Ministerio de Justicia del Perú.
DERECHOS DE LOS TITULARES DE LOS DATOS PERSONALES – DERECHOS ARCO
Queda establecido que los Titulares de los Datos Personales tienen el derecho de ACCEDER a la información que se haya recopilado por cualquier medio legal, RECTIFICAR y corregir los datos en caso de que sean inexactos o incompletos, solicitar su CANCELACIÓN cuando consideren que ya no son necesarios para las finalidades indicadas en la Política de Privacidad correspondiente, y OPONERSE al tratamiento de sus datos conforme a la Ley y las normas pertinentes. LA FUNDACIÓN garantiza el ejercicio de estos derechos en todo momento.
Además, el Titular de los Datos Personales tiene el derecho de REVOCAR el consentimiento que haya otorgado previamente. En este caso, LA FUNDACIÓN cesará el tratamiento de dichos datos, salvo en aquellos escenarios especificados en el artículo 14 de la Ley de Protección de Datos Personales, que establece las circunstancias en las que no es necesaria la obtención del consentimiento del Titular para el tratamiento de su información. Es importante señalar que la revocación del consentimiento no tendrá efectos retroactivos en ningún caso.
PROCEDIMIENTO PARA EL EJERCICIO DE LOS DERECHOS ESTABLECIDOS EN LA LEY DE PROTECCIÓN DE DATOS PERSONALES:
El Titular de los Datos Personales puede hacer ejercicio de sus derechos de ACCESO, RECTIFICACIÓN, CANCELACIÓN, OPOSICIÓN y/o REVOCACIÓN DEL CONSENTIMIENTO de manera directa o a través de un representante legal, enviando el formulario con los requisitos establecidos por la Ley y otras normas pertinentes a la siguiente dirección de correo electrónico: datos@fundacionosma.org, o entregándolo de forma presencial en Jr. Montero Rosas 119, Barranco, Lima.
En la solicitud, se deberá adjuntar, como archivo, una copia del DNI del Titular de los Datos Personales y, si corresponde, también del representante. Igualmente, se deberá incluir la siguiente información:
Nombres y apellidos del titular del derecho, junto con una copia de su documento de identidad (DNI o Carnet de Extranjería).
En caso de ser necesario, datos de identificación del representante del Titular de los Datos Personales, copia de su documento de identidad (DNI o Carnet de Extranjería), y una carta de poder (con firmas legalizadas) otorgada por el Titular.
Correo electrónico y/o teléfono para las notificaciones pertinentes.
Fecha y firma del solicitante.
Una vez recibida la solicitud, LA FUNDACIÓN tendrá un plazo de cinco (5) días hábiles para formular observaciones por incumplimientos que no puedan ser subsanados de oficio, brindando al solicitante un plazo máximo de cinco (5) días hábiles para realizar las correcciones necesarias; de no hacerlo, la solicitud se considerará como no presentada. Desde la fecha de recepción de la solicitud, se computará un plazo de diez (10) días hábiles para proporcionar una respuesta al Titular de los Datos Personales conforme a las disposiciones legales en vigor.
Asimismo, el Titular de los Datos Personales o su representante acepta que toda respuesta de LA FUNDACIÓN a su solicitud será atendida a través del correo electrónico proporcionado para dichos fines.
TRANSFERENCIA DE DATOS PERSONALES POR PARTE DE LA FUNDACIÓN
El Titular de los Datos Personales otorga su autorización y consentimiento expreso a LA FUNDACIÓN para compartir y delegar el tratamiento de su información personal a nuestros proveedores de servicios, ya sean nacionales o internacionales, exclusivamente para los tratamientos mencionados anteriormente.
En aquellos casos donde no se requiera la identificación de los Titulares de Datos Personales implicados en la transferencia, LA FUNDACIÓN se asegurará de que la información pase por un proceso de disociación o anonimización, con el fin de proteger los derechos correspondientes; y en todas las situaciones de transferencia, LA FUNDACIÓN cuidará que los destinatarios actúen conforme a lo establecido en la Ley, utilizando los Datos Personales únicamente para los propósitos permitidos y correspondientes.
Esta disposición incluye, pero no se limita a, empresas dedicadas al desarrollo de comercio electrónico, transporte de nuestros productos, autoridades gubernamentales y demás personas que brinden servicios o colaboren con los fines para los que fue contratada LA FUNDACIÓN.
TIEMPO DE ALMACENAMIENTO
Los Datos Personales que conforman nuestras bases de Datos se almacenarán de forma indefinida, a menos que el titular de los datos solicite la CANCELACIÓN de los mismos como parte de sus derechos ARCO, siguiendo los procedimientos establecidos para ello.
REDES SOCIALES
Las redes sociales son plataformas de comunicación y conexión entre los Usuarios y son ajenas a LA FUNDACIÓN, por lo que no están bajo su responsabilidad. La información y datos proporcionados por el titular de los Datos Personales en redes sociales donde LA FUNDACIÓN sea usuario no son considerados parte de la información personal o sensible protegida por esta Política de Privacidad. Dicha responsabilidad recae en la empresa proveedora de la plataforma y en el Usuario que publica la información.
COMUNICACIONES
Con el fin de mejorar continuamente nuestros procesos, LA FUNDACIÓN podrá realizar modificaciones y correcciones a esta Política de Privacidad, a las cuales usted da su consentimiento. Le sugerimos verificar estos términos regularmente para conocer los cambios que puedan producirse.
Cualquier modificación total o parcial a las disposiciones de esta Política de Privacidad se comunicará a través de alguno de los siguientes medios: un comunicado escrito publicado en las instalaciones de LA FUNDACIÓN, un mensaje enviado a su correo electrónico o teléfono móvil, un mensaje a través de cualquier medio electrónico utilizado para operaciones con LA FUNDACIÓN, o bien a través de los sitios web de LA FUNDACIÓN (https://www.fundacionosma.org) y del Museo Pedro de Osma (https://museopedrodeosma.org).
The purpose of this notice is to inform Users and other visitors of this website, hereinafter referred to as the "Holders of Personal Data", about the processing of Personal Data by the PEDRO AND ANGÉLICA DE OSMA GILDEMEISTER FOUNDATION, identified with RUC No. 20106730467 and located at Jr. Montero Rosas 119, Barranco, Lima, hereinafter referred to as "THE FOUNDATION", and the compliance with the provisions established by the Personal Data Protection Law – Law No. 29733, its Regulations, and complementary regulations, hereinafter referred to as "the Law".
PURPOSE FOR WHICH PERSONAL DATA IS REQUIRED
THE FOUNDATION may request Holders of Personal Data for pertinent information regarding their Personal Data for the following purposes:
To promote the services and products it offers.
To coordinate the sale, delivery, and management of the products it offers.
To verify and consult information of clients, suppliers, workers, and the Complaints Book, for purposes related to the relationship it seeks to establish or has already established.
For security and video surveillance purposes.
To share information with contractors or suppliers when strictly necessary for the proper provision of the agreed services.
To obtain essential contact data for commercial, contractual, and labor relationships.
To address inquiries, complaints and follow up on operations corresponding to each type.
It is expressly stated that THE FOUNDATION acknowledges the right of Holders of Personal Data to oppose the use and processing of their Personal Data when they consider that the information provided does not conform to any of the purposes mentioned above, or if the offered data is not essential to establish a contractual relationship.
The Personal Data handled by THE FOUNDATION will be accessible and managed by the Foundation's collaborators who need this information to carry out the necessary operations and attend to requests from the Holders of Personal Data. Such data will be processed fairly and lawfully, and will not be used for purposes incompatible with those described herein. THE FOUNDATION commits to safeguard the information provided by the Holder of Personal Data with confidentiality, adopting relevant control and security measures to prevent alteration, misuse, unauthorized processing, loss, and/or access by unauthorized third parties.
The Holder of Personal Data expressly declares that all information provided to THE FOUNDATION is accurate, truthful, and given in good faith, releasing THE FOUNDATION from any liability related to the veracity of such information, which includes, but is not limited to, Personal Data, employment, patrimonial, and personal references that the Holder of Personal Data has provided to THE FOUNDATION.

THE FOUNDATION may obtain information about the Holder of Personal Data by any means allowed by the Law, including, but not limited to, obtaining data in person or through electronic platforms and/or websites. By entering their data on the website or providing it in person, the Holder of Personal Data gives their explicit consent to THE FOUNDATION and/or its authorized administrative staff to process the supplied information according to what is stipulated in the Law.
THE FOUNDATION is committed to processing and safeguarding the data of the Holder of Personal Data using digital, technical, and/or administrative means to ensure an optimal level of security.

The Holder of Personal Data is responsible for the accuracy and truthfulness of the information provided. In this sense, the Personal Data collected by THE FOUNDATION will be stored, incorporated, or diligently reorganized according to the corresponding purposes in the databases owned by the Pedro and Angélica de Osma Gildemeister Foundation, which are designated as "clients", "workers", and "suppliers". In the request, a copy of the Holder of Personal Data's DNI should be attached as a file, and, if applicable, also of the representative. Likewise, the following information should be included:
Full names of the holder of the right, along with a copy of their identity document (DNI or Foreigners' Card).
If necessary, identification data of the representative of the Holder of Personal Data, a copy of their identity document (DNI or Foreigners' Card), and a power of attorney (with legalized signatures) granted by the Holder.
Email and/or phone for relevant notifications.
Date and signature of the applicant.
Once the request is received, THE FOUNDATION will have a period of five (5) business days to formulate observations for non-compliance that cannot be corrected ex officio, providing the applicant a maximum period of five (5) business days to make the necessary corrections; otherwise, the request will be considered as not submitted. From the date of receipt of the request, a period of ten (10) business days will be computed to provide a response to the Holder of Personal Data in accordance with the applicable legal provisions.
Furthermore, the Holder of Personal Data or their representative agrees that all responses from THE FOUNDATION to their request will be addressed through the email provided for such purposes.
TRANSFER OF PERSONAL DATA BY THE FOUNDATION
The Holder of Personal Data grants their authorization and express consent to THE FOUNDATION to share and delegate the processing of their personal information to our service providers, whether national or international, solely for the aforementioned treatments.
In cases where the identification of the Holders of Personal Data involved in the transfer is not required, THE FOUNDATION will ensure that the information undergoes a process of de-identification or anonymization, in order to protect the corresponding rights; and in all transfer situations, THE FOUNDATION will ensure that recipients act in accordance with the provisions of the Law, using Personal Data only for the permitted and corresponding purposes.
This provision includes, but is not limited to, companies engaged in e-commerce development, transportation of our products, governmental authorities, and other persons providing services or collaborating with the purposes for which THE FOUNDATION was hired.
STORAGE TIME
The Personal Data that make up our Databases will be stored indefinitely, unless the data holder requests their CANCELLATION as part of their ARCO rights, following the established procedures for it.
SOCIAL NETWORKS
Social networks are communication and connection platforms between Users and are unrelated to THE FOUNDATION, and therefore are not under their responsibility. The information and data provided by the Holder of Personal Data on social networks where THE FOUNDATION is a user are not considered part of the personal or sensitive information protected by this Privacy Policy. Such responsibility lies with the platform provider company and the User who publishes the information.

In order to continuously improve our processes, THE FOUNDATION may make modifications and corrections to this Privacy Policy, to which you give your consent. We suggest you check these terms regularly to be aware of any changes that may occur.
